Joker WILL be in part 3. He's the one that scars Harvey in court (this happens while the Joker is on trial according to Goyer). He will have a smaller role, but he'll be in it. Either way, Harley could still jsut have a minor role.

And I really really hope the Penguin is in this one. A proper version of the Penguin just HAS to be done.
