It's not a licensing issue, Marvel owns the trademark on the term "Captain Marvel". Marvel is free to use "Captain Marvel" as a mark in trade for comic book titles, graphic novels/trade paperbacks, action figures, etc. However, Marvel can not stop DC from calling the original Captain Marvel by that name within a story (be it a comic, t.v. show, movie, etc.) because in such cases DC is not using "Captain Marvel" as a mark in trade.
It would be nice if Marvel and DC could work out a deal to share the trademark on "Captain Marvel", it not an impossible outcome as Marvel and DC already share the trademark on "superhero."
Unfortunately it has been many years since DC and Marvel were anywhere close to the level of cooperation that allowed the Amalgam Universe to exist, much less doing any standard cross over stories, and sadly that doesn't look to be changing anytime soon.
